ethical advertisement of 3d models

Discussion started by Mantas-Talmantas

Do you think it is legal and/or ethical to find
examples where your model is used, and use that game / video / whatever
it is, to advertise your 3d models?

You would not be lying sins
these are your models... but i guess no game dev / ad agency / whatever
would want you to advertise yourself using their game / video
whatever...

What do you think?
If i would grab some seconds
of a game play that shows my models used and made a video and use it in
youtube, or wherever, to advertise my models?

I think without permision of game/video owners, it wouldn't be legal nor ethical.

I would suggest to contact the makers of the game and nicely ask for permission. There is a chance that they wouldn't mind, especially if it's an indy game.

Hello,

Well, I would say yes. As it says in the general terms of use (point 11.2) of the internal rules of CGT, here what is sold is a non-exclusive product license. The property remains the property of the author, (if the property were transferred by the buyer, it would not have limitations to sell it, as it has). But even if the property is transferred, even several times, the author will always be the same, and from the moment of the creation of the work, until the author's death, he will always retain the personal rights over the work, among which is demand due recognition (Article 14 of the Law on Copyright and Related Rights of the Republic of Lithuania).

I think there is a lot of confusion in legal matters, which are important because of the seriousness they may have, and of which people should care more. Because, as it says in Lithuanian civil code in point 1.6 of chapter I (and many others from other parts of the world) "Ignorance of the laws or undue understanding of them will not exempt from the application of the sanctions established in them. , and will not justify the breach of the requirements of the laws, as well as the improper fulfillment of the same. "

Depends what you mean by advertisement? If you are talking about regular facebook, twitter post, for example: "look, i found this game using my model. So cool". Then i don't think you are doing anything illegal or immoral. Even if that post increases your chance of selling the model among your followers... Payed advertisements where you would place a link to your model, but image is from the game, without asking developers for permission, would certainly be immoral, and probably illegal. Cause if image/video is from their game, you are using their work basically to advertise yourself, regardless if the model is yours. Always try to ask for permission from game/video creators.

But let's not forget we are the artists, and getting your name known is the key to success. So don't be to afraid to use any opportunity to promote yourself. As long as it is within the bounds of legality and basic morality.
