Custom Project Rights Ownership

Discussion started by omreso

Hi everyone,

I created a project in the web site and agreed sith one designer for the completion of the 3D print model.

While entering project details, I did not check the box alloowing the designer to sell the final model to others.

My question is, as the owner of the project (request), and not allowing the designer to sell the final model, am I the sole owner of legal rights on the final model?

Can I legally say that this model is legally mine and I can produce physical copies of this model through 3D printing and sell as a product under my brand?

Thanks for replies..

If "resell" is not checked then designer can't resell that model, as far as selling physical copies goes:

https://www.cgtrader.com/pages/terms-and-conditions#general-terms-of-licensing

21.1. Product may not be sold, given, or assigned to another person or entity in the form it is downloaded from the Site or in 3D printed physical
form.

Dear Phantom, thanks for your reply. So what I understand, when I get my model from the designer, I have all rights of the model to sell and distribute. Is this correct?

If model in question is sold under CGT royalty free license, you are not allowed to sell printed physical copies of it. Contact designer and ask for custom license, where designer will allow you selling printed copies.

If you hired a designer through cgtrader and didn't allow him to resell final product, then effectively you own all the rights to the product, except authorship. The answer to your question is yes, you can print and sell physical copies of the model, as long as it doesn't contain any IP to which you don't have the rights. You don't need to contact designer to ask for any special license, that's applicable only in the case of buying stock model.

Dear LemonadeCG, it is very clear-cut explanation. This was I also thought regarding the IP rights of custom projects however I wanted to be sure before proceeding. Thank you for your feedback.
