CGTrader AI Terms of Service

These CGTrader AI Terms of Service ("Terms") apply in conjunction with General Terms and Conditions. CGTrader reserves the right to amend these Terms at any time. In the event of any conflict between these Terms and General Terms and Conditions, these Terms shall prevail.

These Terms govern your access to and use of the AI-powered content generation platform operated by CGTrader and available at https://www.cgtrader.com/ai (the "Service"). The Service enables users to generate three-dimensional models, images, and other related assets through artificial intelligence technology powered by third-party AI model providers, (collectively, "AI Model Providers").

1. Eligibility and Account Registration

1.1 Account Registration

To access the Service you must register for an account on the Site www.cgtrader.com and agree to the General Terms and Conditions and Privacy Policy.

You are fully responsible for all activities that occur under your account, whether or not authorized by you.

1.2 Authorized Users

Access to and use of the Service under your account is limited to you and, where your subscription type permits, your employees, contractors, and agents who have been granted access ("Authorized Users"). You are responsible for ensuring that all Authorized Users comply with these Terms.

2. The Service

2.1 License Grant

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service during the Term solely for your internal, lawful purposes. We reserve all rights not expressly granted herein.

2.2 AI-Powered Generation; Third-Party Providers

The Service operates by routing your inputs to third-party AI Model Providers, which generate outputs on our behalf. You acknowledge and agree that:

• The generation of outputs is performed by AI systems operated by third parties, and we do not control the specific outputs produced;
• We disclaim all warranties and liability with respect to the AI Model Providers' technology, systems, and outputs to the maximum extent permitted by applicable law;
• AI Model Providers may change, update, or discontinue their services at any time, which may affect the availability or quality of our Service without prior notice;
• Company or AI Model Providers may add artificial intelligence-generated marks to the Generated Output, such as watermarks that are visible to the naked eye as well as marks that cannot be directly perceived by humans but can be detected by technical means.

2.3 Service Availability

We will use commercially reasonable efforts to maintain availability of the Service. However, we make no guarantee of uptime, reliability, or uninterrupted access. The Service may be modified, updated, or discontinued from time to time. We will use reasonable efforts to provide advance notice of material changes that negatively affect your use, except in urgent circumstances such as preventing abuse, ensuring security, or complying with legal requirements.

2.4 Subscription Plans

Access to the Service is provided on a subscription basis with defined features and output limits as described on our Pricing page. Subscription features are allocated on a monthly basis and automatically renew each month. Features do not roll over from one month to the next, and once expired, unused features have no value and cannot be reinstated, unless indicated otherwise on our Pricing page. In some cases if you use all your features or output limits allocated for a month, you might be offered to purchase additional features or output limits to continue using the Service. We reserve the right to modify plan features from time to time. Payment, billing information and other rights and obligations of the subscribers are defined in General Terms and Conditions.

3. User Content and Generated Outputs

3.1 User Inputs

As part of using the Service, you may submit text prompts, images, reference files, or other content ("User Inputs"). You represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to submit the User Inputs;
• Your User Inputs do not infringe or violate any intellectual property, privacy, publicity, or other rights of any third party;
• Your User Inputs do not contain personally identifiable information about yourself or any third party, including but not limited to financial information, government identification numbers, or physical addresses;
• Your User Inputs comply with these Terms and all applicable laws and regulations.

3.2 Generated Outputs

The Service will generate 3D models, images, and related assets in response to your User Inputs ("Generated Outputs"). You acknowledge and agree that:

• AI-generated outputs may be inaccurate, incomplete, non-unique, or otherwise unsuitable for your intended purpose;
• Given the nature of AI technology, other users may receive outputs that are similar or identical to yours — we do not guarantee exclusivity of any Generated Output;
• You are solely responsible for reviewing, validating, and evaluating all Generated Outputs before any use or distribution;
• Generated Outputs do not reflect the views, opinions, or endorsements of Company or any AI Model Provider.

3.3 Ownership of Generated Outputs

Free Plan Users: If you use the Service under a free plan, we retain all intellectual property rights in the Generated Outputs. We grant you a non-exclusive, royalty-free license to use, share, and adapt the Generated Outputs for your private non-commercial use.

Paid Plan Users: If you use the Service under a paid subscription plan, you own the Generated Outputs you create, subject to the following: (i) you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use and display your User Inputs solely as necessary to provide and improve the Service; (ii) you grant us a non-exclusive, royalty-free, sublicensable, worldwide, perpetual, irrevocable license to use Generated Outputs in any way for any commercial purpose and agree that we may use Generated Outputs without attribution.

3.4 Community / Public Sharing

If you are a Paid Plan User you may choose to publish or share any Generated Outputs to a public Community Gallery of the Service, while Generated Outputs of Free Plan Users shall always be shared to a public Community Gallery of the Service. In such cases you agree that Generated Outputs may be used by any person for their private non-commercial use subject to the restrictions established in Section 4.1, while User Inputs might be used by other Users of the Service to generate the outputs.

3.5 Storage and Deletion

We are under no obligation to retain User Inputs or Generated Outputs beyond 30 days period for Free Plan Users or 30 days period after the end of subscription for Paid Plan Users. You are responsible for downloading and backing up any content you wish to retain. We may establish storage limits and delete content that exceeds such limits or is associated with inactive accounts.

4. Acceptable Use and Restrictions

4.1 Prohibited Conduct

You agree not to use the Service, User Inputs, or Generated Outputs in any manner that:

1. Violates any applicable local, national, or international law or regulation;
2. Infringes, misappropriates, or violates the intellectual property, privacy, publicity, or other rights of any third party;
3. Involves submission or generation of NSFW content, including but not limited to adult content that depicts frontal nudity, explicit sexual activity, sex crimes, or severe violent content depicting wanton and gratuitous violence, torture, rape.
4. Involves generation of printable 3D models, which are replicas or realistic depictions of weapons;
5. Is defamatory, fraudulent, deceptive, obscene, offensive, harassing, threatening, or otherwise objectionable;
6. Uses the Services in a harmful manner, such as creating Generated Output that may be used for harassing, bullying, abusing, threatening, or intimidating others, creating Generated Output that may be fraudulent, false, or misleading, or represent that the Generated Output is human-generated;
7. Involves the submission of personal data of any person and generation or dissemination of personal identifiable information that can be used to harm an individual;
8. Discriminates individuals or groups based on their age, social, physical, mental characteristics or in any other way;
9. Attempts to reverse engineer, decompile, disassemble, or discover the source code, models, or algorithms underlying the Service or any AI Model Provider's technology;
10. Uses Generated Outputs to develop, train, or improve AI or 3D generation models that compete with Company, or to build services directly competitive with the Service;
11. Uses Generated Outputs for any purposes that can have legal or significant effects on a person, such as decisions regarding finances, education, employment, housing, insurance, legal matters, medical issues, or other important fields without consulting a qualified professional for relevant advice;
12. Introduces malware, viruses, Trojan horses, or other harmful code into the Service or any related systems;
13. Involves unauthorized automated scraping, crawling, or data extraction from the Service;
14. Resells, redistributes, sublicenses, or commercially exploits access to the Service without our prior written consent;
15. Involves buying, selling, or transferring account credentials to or from any third party;
16. Allows multiple users to use a single user account;
17. Impersonates any person, entity, or the Company;
18. Interferes with the proper functioning or security of the Service.

4.2 Responsibility for Content

You are solely responsible for all User Inputs you submit and all Generated Outputs you use, distribute, or share. If you publish or disseminate any Generated Output, it shall be indicated that such Generated Output is generated by artificial intelligence, so as to not confuse or mislead others. We reserve the right to monitor your use of the Service for compliance with these Terms and to remove any User Inputs or Generated Outputs with or without notice, to suspend or terminate your account if we determine you have violated these Terms or any applicable policy.

Service may contain User Inputs and Generated Outputs provided by other Users to which you may have access. You agree that it is impossible for Company to monitor such materials and that you access these materials at your own risk. Company is not responsible for and does not control User Inputs and Generated Outputs. Company has no obligation to review or monitor, and does not approve, endorse or make any representations or warranties with respect to, User Inputs and Generated Outputs. You use all User Inputs and Generated Outputs and interact with other Users at your own risk.

5. Intellectual Property

5.1 Company Intellectual Property

We own all right, title, and interest in and to the Service, including our website, software, documentation, branding, aggregated and anonymized usage statistics, and all underlying technology. Nothing in these Terms transfers any ownership of our intellectual property to you. You are granted only the limited license expressly set out in Section 2.1.

5.2 AI Model Provider Intellectual Property

All intellectual property rights in and to the AI models, algorithms, systems, and technologies provided or used by AI Model Providers remain exclusively owned by those respective providers. We have not transferred, and do not transfer, any rights in such third-party intellectual property to you. You agree not to copy, decompile, reverse engineer, or disclose any such third-party intellectual property.

5.3 Aggregated Statistics

We may collect and use data about your use of the Service for purposes of improving and operating the Service, compiling performance statistics, and developing new features. Such data does not include your User Inputs or Generated Outputs in identifiable form. All rights in such aggregated statistics belong exclusively to us.

5.4 Feedback

If you provide feedback, suggestions, or recommendations regarding the Service, you grant us a perpetual, worldwide, irrevocable, royalty-free, fully sublicensable license to use, incorporate, and exploit such feedback for any purpose, without obligation or compensation to you.

6. Privacy and Data

6.1 Privacy Policy

Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, available at https://www.cgtrader.com/pages/privacy-policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

6.2 Security

We maintain a commercially reasonable information security program designed to protect your data against accidental or unlawful loss, access, or disclosure. However, no security system is impenetrable, and we cannot guarantee the absolute security of your data. You are responsible for maintaining the confidentiality of your account credentials and for notifying us immediately of any suspected security breach.

6.3 Data Processed by AI Model Providers

When you submit User Inputs to generate outputs, your content is transmitted to and processed by our AI Model Providers. Each provider maintains its own data processing and security practices.

7. Copyright and Intellectual Property Infringement

We respect the intellectual property rights of others. If you believe that material on or accessible through the Service infringes your copyright or trademark, please submit a written notice to IP_infringement@cgtrader.com following the requirements established under the Content Policy, which is available here.

Upon receipt of a compliant notice, we reserve the right to remove or disable access to the identified material, notify the accused party, and terminate accounts of repeat infringers.

8. Disclaimers

8.1 As-Is Basis

EXCEPT AS EXPRESSLY SET OUT IN THESE TERMS, THE SERVICE, GENERATED OUTPUTS, AND ALL RELATED CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

8.2 AI Outputs

WE DO NOT WARRANT THAT GENERATED OUTPUTS WILL BE ACCURATE, RELIABLE, COMPLETE, UNIQUE, FREE FROM ERRORS, OR FIT FOR ANY PARTICULAR PURPOSE. DUE TO THE INHERENT NATURE OF GENERATIVE AI TECHNOLOGY — INCLUDING THAT OUTPUTS ARE PRODUCED BY THIRD-PARTY AI MODEL PROVIDERS — OUTPUTS MAY BE INACCURATE, MISLEADING, BIASED, INCOMPLETE, OFFENSIVE, OR LEGALLY NON-UNIQUE. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF GENERATED OUTPUTS.

8.3 Third-Party Providers

WE DISCLAIM ALL WARRANTIES AND LIABILITY WITH RESPECT TO THE AI MODEL PROVIDERS, THEIR TECHNOLOGY, SYSTEMS, AND OUTPUTS. THE AVAILABILITY AND QUALITY OF OUR SERVICE DEPENDS IN PART ON THIRD-PARTY PROVIDERS THAT WE DO NOT CONTROL.

9. Limitation of Liability

9.1 Exclusion of Consequential Damages

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER WE, NOR OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 Cap on Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100).

10. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Company and its affiliates, officers, directors, employees, agents, licensors, and successors from and against any and all third-party claims, actions, demands, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the Service;
• Your User Inputs or Generated Outputs;
• Your breach of any provision of these Terms;
• Your violation of any applicable law or regulation; or
• Your infringement of any intellectual property or other rights of any third party.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.
