Terms and Conditions

The competition is run by CGTrader, UAB (hereinafter - organizer). CGTrader, UAB is registered in the Republic of Lithuania, Vilnius, Naugarduko st. 3, registration number 302935696.

About the competition:

3D Challenge: Sports & Hobbies competition (hereinafter - competition) is organized in order to encourage 3D modellers of CGTrader community to create 3D models that would be suitable for the use in Project Felix, the new beta app by Adobe.

Participating in the competition is free of charge.

BY ENTERING THE COMPETITION, PARTICIPANTS ACKNOWLEDGE THAT THEY HAVE READ, AGREED AND ACCEPTED THE TERMS AND CONDITIONS BELOW.

Prizes:

The winners will be chosen and prizes will be awarded by the organizer in cooperation with Adobe Systems Incorporated (hereinafter – Adobe).

Six winners will be chosen: three in the category for the best model and three for the best portfolio.

Prizes in the best model category:

1st place - $1,500 USD and a complimentary year subscription to Creative Cloud by Adobe;

2nd place winner - $1,000 USD and a complimentary year subscription to Creative Cloud by Adobe;

3rd place winner - $500 USD and a complimentary year subscription to Photoshop by Adobe.

Prizes in the portfolio category:

1st place - $1,500 USD;

2nd place winner - $1,000 USD;

3rd place winner - $500 USD.

The prizes will be transferred to the winners by CGTrader using transfer system (bank transfer or PayPal) agreed with each of the winners individually. Complimentary subscriptions shall be granted either by sharing a link to the license, a redemption code or assigning a license to a particular user account.

The announced amounts of prizes are final and include any payable taxes. All due taxes shall be paid by the respective winner of competition.

Evaluation and Judging Criteria:

Models will be judged based on the following criteria:

  • Ability to meet all technical requirements;
  • quality of the model in regards to its functionality, versatility and appearance;
  • detail, innovation, and general achievement in design of the model;
  • clear and attractive presentation on CGTrader.com and from the perspective of Adobe (it is advisable to include quality model images, write detailed descriptions and apply relevant tags).

The organizer reserves the right to amend the criteria used to judge the models at any time during the competition.

General entry requirements:

3D models complying with the rules set out below (hereinafter - models) must be uploaded to “CGTrader.com” (hereinafter - site). Should the models fail to meet certain competition requirements, CGTrader shall notify the participant that some flaws exist and the model needs to be updated. Models that meet all of the competition requirements, shall be uploaded by CGTrader to “https://stock.adobe.com/”,“https://fotolia.com/”, “https://adobe.com/” (including other Adobe websites and the applications that facilitate the access of these websites or the content made available through them) (hereinafter collectively - other sites). Multiple entries are permitted. When submitting an entry model to this competition, check the 3D Challenge: Sports & Hobbies checkbox to get your model tagged and counted in the challenge. Models uploaded to “https://www.cgtrader.com/gallery” will not be treated as valid entries for this competition, although uploading a model as a showcase to the gallery is not prohibited.

It is expected that realistic models shall be created. The items that can be modelled may include, but are not limited to:

  • Games: Pieces and boards used for chess and checkers, cards, dice, generic game pieces, marbles, pool equipment (cue, ball, chalk), frisbee, croquet mallet, bocce balls, darts or dartboard
  • Sports equipment:
    • Basketball: Ball, hoop with net, sneakers, jersey, generic tennis shoes, whistle
    • Baseball: Ball, bat, bases, hat, knee pads, catcher’s mask, mitt
    • Hockey: Stick, helmet/mask, ice skates, hockey puck, goalie’s net
    • Tennis: Racket, ball, net, ball carrier, wrist or head sweatbands
    • Water sports: Swimming goggles or fins, rowboat, oar, surfboard, water skies, kickboard, life preserver/vest, swimming cap, inner tube
    • Winter sports: Ice skates, snowboard, ski mask, gloves, ski poles, sports flag, skis, snowshoes, sled
    • Other: Boxing gloves, ping pong paddle, shuttlecock, lacrosse stick, golf club(s) and ball(s), archery bow and arrows
  • Exercise equipment: Yoga mat, weights, jump rope, trampoline, stability ball, hula hoop, fitness or activity tracker, stopwatch, timer, generic running or walking shoes
  • Music: Generic musical equipment (saxophone, guitar, violin, flute, piano, accordion, drums), microphone, earphones, music stand, conductor baton, DJ equipment, amp, pick, drumsticks, sheet music, cables and other connecting cords

Employees of organizer and Adobe as well as members of their households or their families (i.e., spouses, parents and children) may not submit models and are not eligible for this competition.

Due date:

Models can be uploaded anytime from 3rd of July, 2017 to the 25th of August, 2017. Competition entries received after the due date will not be considered for a prize. Participation in the competition can only take place online using a registered account on the site. All winners will be notified via the email they used to set up their CGTrader account.

Technical requirements:

The eligible models must meet all of the following technical specifications.

  1. Models should be single-subject only - no groups or series of objects are eligible
  2. ONLY Autodesk’s Maya (.ma or .mb ) or 3ds Max (.3ds or .max) file formats are accepted
  3. Scene should consist of 3D model and connected V-Ray Standard materials only:
    1. No lighting setups
    2. Hidden and unused nodes should be deleted from the scene
  4. Materials assigned to geometry must be V-Ray Standard Material (VRayMtl)
    1. Texture maps in PNG format
    2. Texture image should be square resolutions (minimum of 2K, 2048 x 2048)
  5. 3D models do not have any missing faces or open holes.
  6. Real world scale (centimeters)
  7. Rotate asset so the most interesting side faces toward Z Positive axis in Maya or Y Positive Axis in 3ds Max.
  8. Freeze Transformations (Reset xForm in Max).
  9. Place models so they sit on top of the origin (0, 0, 0). No floating models.
  10. UV Layout (0-1 space, non-overlapping)Only quads are accepted.
  11. Triangles can be used sparingly and only where absolutely necessary.
  12. English is used when naming files. Use camelCase or underscores
  13. Preview image render (no texts in the images)
  14. Topology:
    1. No subdivisions surfaces
    2. Poles should have maximum of 5 edges.
    3. Flatten all modifiers ("delete history") before submission.
  15. Normals for the entire asset should have consistent facing direction.
  16. Model should not display any logos or trademarks.

Legal requirements:

By entering in the competition the participants hereby irrevocably warrants and guarantees that:

  1. participants have the right to participate in the competition and to commit themselves under these terms and conditions. If a work is uploaded on behalf of an entity, then these terms and conditions apply to that entity and its affiliates; in such case, the participant uploading the work represents and warrants to have the authority to bind the entity to these terms and conditions.
  2. all information submitted in the work is unique, true, accurate and complete in every respect. The organizer reserves the right to verify any information contained in the work and/or the participant’s eligibility to enter the competition.
  3. the participant owns all rights, title and interest in and to the work, including all copyright, trademarks, patents, rights of privacy, rights of publicity, moral rights, and other intellectual property rights (collectively - IP Rights).
  4. the participant hereby grant the Organizer and Adobe a license to further sublicense their right to use, reproduce, publicly display, distribute, modify, publicly perform, and translate the work on a non-exclusive, worldwide, and perpetual basis in any media or embodiment. The license to the end users of the work may include the right to modify and create derivative works based upon the work, including but not limited the right to sell or distribute for sale the work or any reproductions thereof if incorporated or together with or onto any item of merchandise or other work of authorship, in any media or format now or hereafter known, provided that such end users’ use of the modified work is limited solely to the same uses permitted with respect to the original work.
  5. the work does not infringe or violate the IP Rights of any person or entity, or that constitutes any libel, slander or other defamation upon any person contain misleading or false information, or contain any illegal or defamatory content. If the work contains images or likeness of an identifiable person, trademark, or logos or certain distinctive property that is protected by IP Rights, the participants represent and warrant that they have obtained all necessary and valid releases or agreements.
  6. the submitted work does not include any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing overt brand sponsorship, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights).
  7. their submitted work is original;
  8. by participating in the competition the participant licenses the Organizer and Adobe, acting separately, with the copyright and other intellectual property rights in the work for the purposes referred to in these terms and conditions, also gives irrevocable permission to use, reproduce, publish, display, transmit, copy, amend, store, sell and sublicense the work worldwide, including but not limited to, on site and on other sites as defined in these terms and conditions.
  9. the submitted work shall not be withdrawn from the site and other sites for a period of 6 months following the end of the competition. Should the participants fail to observe this obligation and the work is withdrawn, the organizer and Adobe, acting separately, are hereby entitled to restore the work and continue to license the work for the remaining time of that 6 months period. Winners of the competition shall be obliged to immediately return the prizes, should they fail to observe above named guarantee.
  10. submitted works comply with the Legal Guidelines for Adobe Stock Contributors;
  11. submitted works do not violate any rights or legitimate interests of any third parties.
  12. the participant will indemnify the Organizer and Adobe, including their subsidiaries, affiliates, officers, agents, employees, partners, licensees, and licensors from any claim, demand, loss, or damages, including reasonable attorneys’ fees, arising out of or related to the work or violation of these terms and conditions, accordingly the participants give the right to control the defense of any claim, action or matter subject to indemnification by participant. The participants undertake to fully cooperate with the Organizer and Adobe in the defense of any such claim, action or matter. Any amount owed to the participant may be offset and reduced by any amount owed by participant pursuant to his indemnity obligations hereunder, without demand or notice to participant.

Participants of competition can set price for the work on the site, while Adobe will have the right to unilaterally re-evaluate and establish the price of the work on other sites based on Adobe benchmarks. By participating in the competition the participants irrevocably consent to any price for the work to be established by Adobe, including consent to any amount of royalty fee to which the participant will be entitled upon sale of the work on other sites. The participants of the competition shall be informed of the royalty fees established by Adobe in advance, however they shall not be subject to negotiations. Preliminary, the participants shall be entitled to a royalty fee of 40 percent on all sales of their works on other sites, which shall be distributed via CGTrader. The royalties collected from sales on Adobe will be paid monthly adding to earnings from CGTrader marketplace, or, in specific cases, when the required amount is collected.

General Terms:

By submitting a work for competition, participant is agreeing to be bound by these terms and conditions.

Organizer will not accept responsibility for competition entries that are not registered or uploaded correctly, regardless of cause, including, for example, as a result of equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

The competition entries will be judged based on the subjective interpretation. The decision regarding the winner will be final.

The Organizer reserves the right in its absolute discretion to disqualify any participant of the competition if it has reasonable grounds to believe that a participant has breached any of these terms and conditions, any applicable law (including copyright law) or has otherwise infringed the intellectual property of any other person. Each participant acknowledges and agrees that any failure to comply with these terms and conditions could lead to Organizer disqualifying that participant, without giving any reason for such disqualification or granting any opportunity for challenge.

In the event that a prize-winner is disqualified from the competition, the Organizer will select an alternative prize-winner in the same manner as the original prize-winner and such selection will be subject to these terms and conditions.

Organizer will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 30 days of the announcement of the winner, the Organizer reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received. The organizer and/or Adobe may, but is not required to, make a preview of a work available on its social media channels and websites and any other media, whether now known or invented in the future, and in connection with any publicity of the competition without any compensation payable.

The Organizer and/or Adobe may allow their users and other relevant third parties to post or share the work directly or indirectly onto social media to better promote the model. Social media means a website or application which has a primary focus on facilitating social interaction among its users and allowing users to share content in connection with such social interaction. The Organizer and Adobe may not be liable (i) for any terms of use or other provisions or authorizations which may appear on any social media, even if such social media sites explicitly or implicitly allow third parties to access, download, share or use the work in any way; or (ii) for any use whatsoever made by any third party who accesses the work directly or indirectly via social media sites.

The Organizer and Adobe may for the purposes of marketing and promoting of their business, the model, the site, other site, in which event the participant hereby grants a non-exclusive, worldwide, and royalty-free license to use, reproduce, publicly display, distribute, modify (so as to better showcase the work, for example), publicly perform, and translate the work as needed.

The participants grant the Organizer and Adobe a non-exclusive, worldwide, perpetual, and royalty-free license to use, reproduce, distribute, index, and modify the work for the sole purposes of operating the site and/or other sites, presentation of the work, promoting, distributing and marketing the work to end users, developing new features and services, archiving the work, and protecting it.

Participants grant the Organizer and Adobe the right, but not the obligation, to use participant’s name, trademarks, and trade names in connection with license to the work under these terms and conditions.

By entering the competition participants agree that any personal information provided by them with the competition entry may be held and used only by Organizer and Adobe to administer the competition.

The Organizer reserves the right to hold void, suspend, cancel, or amend all or any part of the competition where it becomes necessary to do so. Any changes to these terms and conditions, or cancellation of the competition, will be posted on the site. It is the responsibility of participants to keep themselves informed as to any changes to the terms and conditions.

These terms and conditions and any dispute arising out of or in connection with them or their subject matter (including any non-contractual disputes or claims) or competition shall be governed by the law of the Republic of Lithuania, and the parties submit to the exclusive jurisdiction of the courts of the Republic of Lithuania.
