Original logo

Discussion started by PsyTi

Hello everyone. I have no knowledge about digital versions of the product and their correct presentation for sale. Would love to hear some good advice on this.

For example, I am making a 3D model, specifically weapons. I want to put it for sale in the stores in the future. Many parts (stock, scope, magazine, etc.) have their own original names and logos, can I directly transfer them to my weapon model?

On the Internet, I came across various information. Someone says that it will be enough just to indicate the name of the original product in the description, etc.. Someone even says that such use entails litigation. At the same time, I came across a huge number of models where the original names and logos are drawn (not only weapons), and that models are for sale.

So the question is - can I do this, transfer the original logos, or do I need to come up with my own names and draw my own logos? And the next question - will it not be worse?

Models can be removed after submitting DMCA takedown notice or without it if the models optimize for 3D printing. The fact that somewhere someone sells models with original name and logos is not a factor that, in the event of litigation, will be interpreted in your defense. It is best to use only your textures, logos, names, decals and blueprints.

This site has a huge number of 3D models of weapons, which are made according to original, existing models. And many of them also have original, existing logos and names. I don't think they all bought a license or whatever. I mean, if I make a model of a weapon, according to the existing one (from a photo on the Internet) and at the same time I replace real logos with fictitious ones

For example in 2016 BMW Group filed a lawsuit due to trademark and patent design rights infringement. The claim included all logos since 1955. There were a huge number of car models for sale at that time. As a result all models have been removed and the ban is still in effect today. If you now upload a model for example BMW X5 with a different logo and the name of WBM X25 it will still be deleted. Nobody and nothing prevents Smith and Wesson company (for example) from filing the same lawsuit, it's only a matter of time.

Of course you can sell branded 3D model with logos (for example Volkswagen, Nike, Boeing etc.).
Most of the brands are allowed for selling.
There are few examples/exceptions like BMW which are prohibited from selling.

So as you said you should indicate the name of the original product in the description.
And you should choose Editorial licence.
And of course you should not remove logos from branded models and sell it as "generic".

hm. Something I'm completely confused. Many say quite the opposite, that this is not worth doing. Many people talk like you. How to figure it out?) and tell me please, what is an editorial license and where can I get it, I'm completely new

You choose the Editorial licence in publisher when uploading new 3D model to CGTrader. And I don't know what is the opposite that it is not worth to sell branded models with logos or what? The legal and right way is the only one. If selling branded model you must sell it as branded models with all the logos. Sometimes the model can be deleted when company like BMW decides it.

And the editorial licence means that the intellectual property (design, idea of the model) belongs to the company (for example Volkswagen). So if somebody buys such 3D model from you the buyer must ask for permission to use the model commercially. For you nothing complicated or dangerous - you only choose this type of licence.

Thanks, I understand you. But here's what they answer me elsewhere. And no one said a word about this license "Your question boils down to "Is it legal to sell something based on a design that don't own any licence for", and the answer is no."
