License and taxes questions from a begginer.

Hi

I'm new here and I'm learning 3d modelling for about 2 years now and I'm thinking about selling my models on this site (someday ;) ), but I have some questions:

1. For example - I will do a Gibson SG guitar model and put a Gibson logo on headstock - it's that model legal to sell if I don't own any permissions to use that logo? And if its legal which license should I "stick" to that model? Same question for cars and car brands logos, designs etc.

2. I'm from Poland - and I've read that that site calculates VAT tax and subtract certain amount of money from my sell - that means I don't need to pay any more taxes in my country or should I ask a lawyer (you know taxes for income some sort)?

Hi aodsto welcome to the community! :)

1) Technically speaking using company logo's without their permission is a breach of copyright, however it's highly unlikely you'll ever be called up for it. Personally I think its better to be safe and leave the logo's off.

2) VAT is deducted from the total amount of a sale (around 20% I believe), however this only applies to sales made inside Europe. So for example, if someone in America purchases your model, then no VAT is taken. You will not have to pay any additional taxes, unless you start making a substantial amount of money. Different countries have different laws regarding income from royalties, but generally the money made is added to your annual income which is then taxed at the end of each tax year.

In addition to question 1 - and how about shapes and designs - I won't add any logos and brands but I will do for example SG guitar or Fiat Panda (sorry for same examples ;P) based on real life objects or references - It's legal? I've read somewhere that someone can sue me for that too.

In addition to question 2 - So in short - if I earn more than value called "tax free value" (I think I can translate this like this) in one year I must pay tax at end of the year for amount that's higher that tax free value in my country. Shame that Poland have one of least TFV in the world :< Sorry for that I needed to visualize that but for sure I'll contact an lawyer.

I understand that if the creator of the design has it registered as his "intellectual property" is a violation of the law, but as mentioned above, it is rare that there are penalties here on that subject currently (I have seen models of canon cameras with everything the hyperrealistic design and the logo). If you do not want problems I advise you not to get involved or try.
