Characters from Black Ops 3 and Infinite Warfare games are being sold. Is it legal? Calling the author JulesCG.

Here's the answer from support:

@"The seller earlier confirmed that he is one of the COD designers who
worked on 5 COD titles and this is a derivative work. These designer
models are already reported in the past due to same reason. The easiest
answer why they look so similar is due to the fact that models are
created by the same designer. The models are not exactly the same as in
the game since this could breach copyright rules but since this designer
works with COD he probably has a legitimate reason to sell that kind of
model. Attaching a citation from a designer "The model on CGTrader is a
complete work... a completely different model up to 8k bakes, thing
that only CGTrader have."If in doubt we would suggest contacting model
designer for clarification."@

Does author holds exclusive rights to sell these models? Can he confirm that somehow if yes? Can I get into trouble from using it in commercial projects for "using copyrighted images from famous games"?

Why dont you just contact JulesCG and ask? Looks like support have already informed you about your other query.

Contacted him but I'd also want to hear public opinion. The models are VERY similar and such giant as Activision has literally tons of lawers and could sue you even if you technically hold the rights for using "widely known character concepts owned by company" or something like that.

Well if hes a designer for Call of Duty then he would be risking his job if what he was doing wasn't ok. My opinion is - if this is a personal query of yours it would be more professional just to contact JulesCG directly. I think its just polite to ask JulesCG if you can then post this publicly - otherwise it may seem like defamation. My 2 cents.

I think it's polite to let people know where these models originally came from. Also many of the characters for Infinite Warfare were created by Spanish outsource studio and even on _images_ of those characters there is a mark "property of Activision, used with permission".

These models are available online for a very long time, long before he even uploaded those here. As far as I know, as game company employee (if he is one wich i doubt) is not allowed to sell asset made for game because those are property of right holder in this case Activision. What i think he has done here is took those ripped models and modify them so he can sell that here.
As you can see in the link below here is the original gun from COD BO3, just to proove that those models are available online.

If I were you i would pass this, because its to risky in every single way.

Well, the problem is I already got it, requested refund but now I need to prove to CGTrader Support that JulesSG is NOT one of COD designers as he himself claims. This is getting ridiculous. I've already sent tickets to Activision support and mailed to Elite3D studio and some artists.

I don't see a reason why you need to prove anything to anyone, you are the one who is not satisfied with the model for a very good reason.

My answer in Clear words, Sell what you're designing from scratch and go by your own nature of designing.
