CGTrader Giveaway Rules

Below are the official rules for the giveaway organized by CGTrader:

A valid CGTrader account is required for entry. A valid platform (defined below) and Internet access are required for entry. No purchase or payment of any kind is necessary to enter or win. A purchase will not increase your chances of winning. Sweepstakes (the “Sweepstakes”) is sponsored by CGTrader. The Sweepstakes is governed by these official rules (“Official Rules”).

The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Facebook, Inc. (“Facebook”), Twitter, Inc. (“Twitter”), Pinterest, Inc. (“Pinterest”), Facebook Inc. (“Instagram”), Adobe, Inc. (“Behance”) or any other platform subjected and described in (“How to Enter”) section of these official rules. Any questions, comments or complaints regarding the Sweepstakes should be directed to CGTrader.

1. ELIGIBILITY

The Sweepstakes is open only to those who have a valid account on the CGTrader platform (www.cgtrader.com) and who are 18 years old as of the date of entry. The Sweepstakes is open to legal residents of any country and is void where prohibited by law. Employees of CGTrader, which belongs to UAB “CGTrader” (the “Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

2. AGREEMENT TO RULES

By participating, you agree to be fully and unconditionally bound by these Official Rules and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of CGTrader as final and binding as it relates to the content. The Sweepstakes is subject to all applicable federal, state and local laws.

3. SWEEPSTAKES PERIOD

The Sweepstakes begins on September 2nd, 2020 at 2:00 PM (GMT+3) and ends on/at September 18th, 2020 at 11:59 PM (GMT+3) (the “Sweepstakes Period”). All entries must be received during the Sweepstakes Period as further set forth in the “How to Enter” section of these Official rules.

4. HOW TO ENTER

Eligible individuals (see Eligibility section of these Official rules for eligibility requirements) can enter the Sweepstakes by visiting the page https://promotions.cgtrader.com/special-giveaway and following the instructions in the call to action part for this Sweepstakes posted by CGTrader on the account (“How to Enter the Giveaway”). The entry will be valid after satisfying any of these conditions (i) writing a public post on Facebook; (ii) writing a tweet on Twitter; (iii) creating a public pin on Pinterest; (iv) adding a public image on Instagram; (v) creating a project on Behance; or (vi) creating a public post on any other Platform. Any of these entry options need to have the hashtag #CGTspecial and valid participant’s username on CGTrader and should be publicly visible. When sharing to platforms outside social media, the Participant must take a screenshot of the shared link with hashtag #CGTspecial and valid participant’s username on CGTrader as proof and simply send a message to CGTrader's support team at support@cgtrader.com or Facebook Page together with Participant's CGTrader username.

All participants of the Sweepstakes must have a valid CGTrader account.

There are unlimited entries per person and per single Platform account or accepted action during the Sweepstakes Period, regardless of method of entry. There is a limit of Prizes (defined below) per participant. Each entrant’s Platform profile settings must allow for CGTrader to view and detect his/her Entry Post and to communicate with him/her via the Platform (including, without limitation, following/liking CGTrader’s account on the Platform during the Sweepstakes Period and through the time of Prize award, where necessary). It is each entrant’s responsibility to timely set his/her account settings, so that CGTrader is able to view his/her Entry Post and communicate with him/her. CGTrader is not responsible for misspellings, typographical errors, or other issues that may affect an Entry Post from being located using a search to find eligible entries.

Your Entry Post will not be deemed an entry in the Sweepstakes until CGTrader verifies that it complies with these Official Rules and the Platform’s applicable policies; but, otherwise, the substantive content of the Entry Post will not affect an entrant’s chances of winning. Such approval or disapproval of an Entry Post will not be communicated. CGTrader, at its sole discretion, may accept or disqualify an Entry Post that is accompanied by a technically incorrect required unique term or content in addition to the required content. Your Entry Post must remain active on your Platform account through winner selection and prize award for the Sweepstakes to be eligible. Your Entry Post may appear on your Platform account feed and may be visible to other users or the public. Incorrect and/or incomplete attempts at entry or those identified or received outside the Sweepstakes Period, and/or Entry Posts that contain obscene, offensive, or objectionable language or language that violates a third party’s intellectual property rights or communicates messages inconsistent with the positive images to which CGTrader wishes to associate (all as determined by CGTrader in its sole discretion) will be void and not eligible for entry.

For purposes of this Sweepstakes, an Entry Post is “received” when CGTrader is able to verify that it was posted on the Platform during the Sweepstakes Period. Each entrant must be the rightful owner of the Platform account utilized for entry. The Platform’s database clock will be the official timekeeper for this Sweepstakes. Entries may not be made jointly or by any group and may only be made by an individual. Entries must be received via the Platform and in strict accordance with the instructions and restrictions on the Platform and these Official Rules. Facsimiles, mechanical reproductions, alterations, garbled, incomplete, misdirected, lost, late, mutilated, or forged entries, or entries generated by a macro, bot, or other automated means will not be accepted and are void. Those who do not follow all of CGTrader’s instructions, provide the required information in their entry, or abide by these Official Rules will be disqualified. Entries made by any other individual or any entity, and/or originating at or using any other website, including, without limitation, commercial promotion subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes.

The use of any device or process to automate the entry process is prohibited. Such entries will not be acknowledged.

5.SUBMISSION REQUIREMENTS

Entry Post, and any accompanying content or information (collectively, “Entrant Content”) must meet all of the requirements in these Official Rules, including the following, or the associated entry will be disqualified:

• Entrant Content must comply with all applicable terms of the Platform.
• Entrant Content must NOT depict, identify or include any person other than the entrant.
• Entrant Content must not create or imply any association between CGTrader and any individual, entity, or anyone else or his, her, or its products or services.
• All aspects of the Entrant Content must be originally created by and solely owned by you (or be in the public domain). Except for materials in the public domain, all third party content and content unoriginal to you is prohibited.
• Entrant Content must not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyright, including moral rights, trademark, trade secret, or right of privacy or publicity.
• Entrant Content must be unpublished and not have been submitted in any other contest, sweepstakes, promotion, or competition.
• Entrant Content must not include information or content that is false, fraudulent, deceptive, misleading, defamatory, threatening, trade libelous, slanderous, libelous, disparaging, unlawfully harassing, profane, obscene, pornographic, hateful, indecent, inappropriate or injurious to any individual, any Sweepstakes Party, or any third party.
• Entrant Content must not contain or describe any harmful or illegal activity or content or in any way violate any federal, national, state, provincial, territorial, or local laws, rules or regulations.
• Entrant Content must be suitable for presentation in a public forum.
• Entrant Content must not suggest, depict, or describe any inappropriate, unlawful, or dangerous behavior or use of CGTrader’s products or services.
• You agree that your participation in the Sweepstakes and agreement to these Official Rules and any Sweepstakes Party’s display and use of the Entrant Content will not violate any agreement to which you are a signatory or party.
• You agree to indemnify the Released Parties (defined below) against any and all claims from any third party for any use or reuse by any Sweepstakes Party of the Entrant Content.

6. PROCEDURE OF AWARDING PRIZES

Entries that comply with the Official Rules and all instructions of CGTrader and are received during the Sweepstakes Period (“Eligible Entries”) will be gathered into a database at the end of the Sweepstakes Period. On September 18, 2020 at the CGTrader office, located at Antakalnio 17, Vilnius, Lithuania, fifty-eight (58) eligible entries will be selected by random computer-generated draw from among all Eligible Entries for the Prize. The odds of winning depend on the number of Eligible Entries.

The decisions of the Sweepstakes Sponsor with respect to all aspects of the Sweepstakes, including, without limitation, the drawing results, are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility and/or disqualification of entries and/or entrants.

The winners will be announced by or about September 21, 2020 by CGTrader staff directly by email associated with Entrant’s CGTrader username (“Notification Message”), and/or by direct message on the Platform of entry (if applicable) (“Notification Message”). Such Notification Message will contain instructions for the next steps in the winner verification process. Each entrant is responsible for setting up his/her Platform account so that he/she may receive and/or view such Notification Messages(s) and/or other communications from CGTrader and monitoring his/her Platform account for such Notification Messages(s) and/or other communications related to the Sweepstakes. To receive such a Notification Messages and/or other communications from CGTrader, you may be required to affirmatively accept such communications from CGTrader and/or like/follow CGTrader’s account on the Platform (if applicable). The potential winner must respond to CGTrader according to the instructions in the Notification Message within 7 days, or the potential winner may forfeit the Prize and any further participation in the Sweepstakes in CGTrader’s sole discretion.

7. PRIZES AND APPROXIMATE RETAIL VALUE

There are fifty-eight (58) Prizes available in this Sweepstakes. The Prize consists of the following (“Prize”):

• Marketplace Voucher(s)
• Free Sales (with 100% royalty rate)
• CGTrader Loyalty Credits (CLD)

There is a limit of 1 Prize per single participant. By September 21, 2020, the winner will be able to select the Prize based on the following Prize distribution:

• Tier 1 - 3 Prizes: Marketplace Voucher (valued at $200) OR 15 Free Sales (with 100% royalty rate)
• Tier 2 - 5 Prizes: Marketplace Voucher (valued at $100) OR 10 Free Sales (with 100% royalty rate)
• Tier 3 - 10 Prizes: Marketplace Voucher (valued at $50) OR 7 Free Sales (with 100% royalty rate)
• Tier 4 - 15 Prizes: CGTrader Loyalty Credits (CLD) (valued at $200) OR 5 Free Sales (with 100% royalty rate)
• Tier 5 - 25 Prizes: CGTrader Loyalty Credits (CLD) (valued at $100) OR 3 Free Sales (with 100% royalty rate)

Actual/appraised value may differ at time of prize award. The specifics of the prize shall be solely determined by the Sponsor.

CGTrader is not responsible for and will not replace any lost, mutilated or stolen Prize or any Prize that is undeliverable or does not reach the winner due to incorrect or changed contact information. If winner does not accept or use the entire Prize, the unaccepted or unused part of the Prize will be forfeited and CGTrader will have no further obligation with respect to that prize or portion of the Prize. CGTrader is not responsible for any inability of the winner to accept or use the Prize (or portion thereof) for any reason. CGTrader reserves the right to substitute the stated Prize or portion thereof with another prize or portion thereof of equal or greater value for any reason, including, without limitation, Prize unavailability. No more than the stated Prize will be awarded.

No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is non-transferable. Any and all Prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of Prize to others or request for the cash equivalent by winners is permitted. Acceptance of prize constitutes permission for CGTrader to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

8. WINNERS SELECTION AND NOTIFICATION

Winners of the Sweepstakes will be selected in a random drawing under the supervision of the Sponsor.

Following the winners selection, winners will be notified via email to the email address associated with their respective CGTrader account or via personal message which is associated to his/her Social Platform Profile (if applicable) by September 21, 2020. CGTrader shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk email or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If a selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, prize may be forfeited and an alternate winner selected.

Any violation of these Official Rules by any winner (at Sponsor’s sole discretion) will result in such winner’s disqualification as winner of the Sweepstakes and all privileges as winner will be immediately terminated.

9. RIGHTS GRANTED BY YOU

By entering this contest you understand that CGTrader, anyone acting on behalf of CGTrader, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner’s name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

10. TERMS

CGTrader reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, CGTrader may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by CGTrader. CGTrader reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions.

CGTrader has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void votes for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and, should such an attempt be made, CGTrader reserves the right to seek damages from any such person to the fullest extent permitted by law.

11. LIMITATION OF LIABILITY

By entering you agree to release and hold harmless CGTrader and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

12. DISPUTES

As a condition of participating in this Sweepstakes, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased.

13. WINNERS LIST
